The beneficiary clause

This is the key element of your Assurance Vie contract since it designates who will receive the capital at the time of your death. You designate the person(s) who will receive this capital and according to what distribution.

IT'S A FREE CHOICE

They can be your spouse, your PACS partner, your partner, a member of your family, a friend or even an association which is legally allowed to receive donations.

Our advice: do not infringe the rights of your compulsory heirs. They could claim against your designated beneficiary(ies) in the event of payment of manifestly exaggerated sums.

AS MANY BENEFICIARIES AS YOU WISH

You designate the person(s) who will receive this capital and according to what distribution.

The point of attention: this transmission takes place outside your estate and benefits from the specific taxation of assurance vie (articles 757 B and 990 I of the General Tax Code).

ANYTIME

In order to adapt it to your situation (divorce, remarriage, birth...) so that it is always in line with your transmission wishes.

Our recommendation: in all cases, you should regularly ask yourself whether or not you need to update your clause and talk to your Crédit Agricole adviser, he can tell you how to update or better draft your clause!

IDENTIFICATION If you designate the beneficiaries by their first and last name, give details of their marital status, date and place of birth, address, etc.

THE DISTRIBUTION If you want an unequal distribution, specify it as a percentage: for example "50% for XX, 25% for YY and 25% for ZZ".

NEXT RANKING BENEFICIARIES Don't forget to plan for second-ranking beneficiaries in case the first designated beneficiaries have died before you. For example: "YY failing that, his children born or to be born"

THE SAFEGUARD CLAUSE Always end your clause with “failing this, my heirs”, so as never to leave the capital without a beneficiary.
